EncryptBox TERMS & CONDITIONS

Thank you for choosing EncryptBox. This User Agreement ("Agreement") governs your use of the services provided by FlexHub LLC ("we," "us," or "our") through the EncryptBox website and any related mobile applications (collectively, the "Service").
By accessing or using the Service, you agree to be bound by this Agreement.
1. Definitions
Service: The Service encompasses all functionalities provided by EncryptBox, including, but not limited to, file storage, sharing, and collaboration services available through the EncryptBox website and any officially related applications.
Content: Content refers to any files, documents, images, or other materials that users upload to EncryptBox or any other material that is related to EncryptBox and its services.
2. Prohibited Activities
You agree not to use the Service to:
- Communicate, upload, post, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Communicate, upload, post, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
- Communicate, upload, post, transmit, or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
- Communicate, upload, post, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
- Communicate, upload, post, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
- Impersonate any person or entity, including, but not limited to, a FlexHub LLC official, forum leader, guide, or host, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Harm minors in any way.
3. Uploaded Content
By using EncryptBox, you agree that:
- Users are solely responsible for the security and integrity of files uploaded to EncryptBox. FlexHub LLC shall not be held liable for any loss, theft, unauthorized access, or compromise of user-uploaded content.
- FlexHub LLC is not responsible for unauthorized access to user uploaded files, including any personal information that you have uploaded of your own volition.
- You retain all ownership rights to the content you upload. By using our services, you grant FlexHub LLC (the corporate owner of EncryptBox) a limited, non-exclusive, royalty-free license to use, store, and process such content solely for the purposes of identity verification and other related services. This license is necessary for us to provide you with the service, and we will not use your content for any other purposes without your explicit consent.
4. User Rights
- Ownership: You retain all ownership rights to the content you upload to the Service.
- License Grant: By uploading content, you grant FlexHub LLC, the owner of EncryptBox, a worldwide, non-exclusive, royalty-free license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display your content solely for the purpose of operating and promoting the Service. This license may extend to another company in the event that FlexHub LLC transfers ownership or control of the Service.
- Flexibility: FlexHub LLC reserves the right to amend the terms of this Agreement as necessary to comply with legal requirements and to address future business needs, including mergers, acquisitions, or other corporate transactions.
5. Privacy
Your privacy is very important to us. Our Privacy Policy explains how we collect, use, and protect your information.
By using EncryptBox, you agree to the collection and use of information in accordance with the Privacy Policy.
6. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of FlexHub LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
7. Termination
FlexHub LLC may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under its sole discretion, for any reason whatsoever, including, without limitation, a breach of the Agreement.
8. Limitation of Liability
In no event shall FlexHub LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- (1) Your use or inability to use the Service;
- (2) Any unauthorized access to or use of our servers and/or any personal information stored therein;
- (3) Any interruption or cessation of transmission to or from the Service;
- (4) Negligence or wrongdoing of other users who use this website, including but not limited to users who are involved in mutually-shared documents who would then have access to your information/documents, possible problems that arise due to communications between parties, and any litigation between said parties;
- (5) Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our Service by any third party;
- (6) Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service;
- (7) Any loss of your data or content from the Service.
FlexHub LLC is absolved of all responsibility when it comes to litigation amongst parties and shall not be liable for any damages due to the lack of enforceability of a contract. This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

10. Changes to the Agreement
FlexHub LLC reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, you will be required to accept the new Agreement before continuing to use the Service. What constitutes a material change will be determined at our sole discretion.
11. Governing Law
This Agreement shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
12. Dispute Resolution and Arbitration
Any disputes arising out of or relating to this Agreement or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The place of arbitration shall be California, and the language of the arbitration shall be English. Each party shall bear its own costs and attorney's fees.
13. User Obligations
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for any and all activities that occur under your password or account.
14. Entire Agreement
This Agreement constitutes the entire agreement between you and FlexHub LLC regarding the use of the Service and supersedes any prior agreements between you and FlexHub LLC relating to the Service.
15. Ownership of Code, Templates, and Design
The website’s code, the templates provided, and the overall design of the EncryptBox platform are the exclusive property of FlexHub LLC, operating as EncryptBox. All rights are reserved. Unauthorized reproduction, distribution, or use of the code, templates, or design elements is strictly prohibited and will be prosecuted to the fullest extent of the law.
